Nilan Johnson Lewis Successfully Defends Client Evenflo Against Class Action Claims

Nilan Johnson Lewis attorneys Amanda Cialkowski, Cortney Sylvester and John Wackman have successfully defended their client Evenflo Company, Inc., in the United States District Court for the District of Minnesota. On June 25, 2015, the court granted Evenflo’s motion to dismiss the class action case, which had alleged deceptive trade practices, false statements in advertising, violations of the Magnuson-Moss Warranty Act, breach of implied warranty of merchantability and breach of implied warranty of fitness for a particular purpose.

Lead plaintiff Sadie Browe alleged that the harness buckle of her child car seat was unreasonably difficult to unlatch and therefore defective. Oral arguments were heard on April 1, 2015, where Nilan Johnson Lewis attorneys presented the motion to dismiss on behalf of Evenflo.
