ERISA and Employee Benefits Litigation and Compliance
Our ERISA/Employee Benefits group handles cases in all federal circuits involving claims for disability, life and health insurance benefits primarily based upon ERISA. Our primary expertise is defending the insurance carrier’s adverse claim determination to the district court and on appeal. We also defend ERISA claims brought against employers under ERISA for breach of fiduciary duty, interference with protected rights, and failure to provide plan documents.
Over the past several years our clients have obtained significant victories in the life and disability area. Our clients include Metropolitan Life Insurance Company, ReliaStar Life, Hartford Life, Reliance Standard Life, Madison National Life, Combined Insurance Life, and Primerica Life.
We also litigate ERISA-exempt claims under governmental and church-sponsored plans, and individual policy claims in state courts in the upper Midwest states of Minnesota, Wisconsin, Iowa, South Dakota and North Dakota. Aside from the litigation aspect of our services, we deliver results on claims based on the client’s business needs and objectives.
