EPL and D&O Panel Experience
Our labor and employment team has the skills and experience to handle claims under your EPL and D&O coverages.
We routinely handle litigation for employers across the country, and our attorneys have defended employment claims in nearly every state, well-poised to defend employment claims on a national or regional basis. We handle litigation and serve as regional counsel for national employers in the Upper Midwest (Wisconsin, Minnesota, Iowa, Nebraska, and the Dakotas) and California. We have found that employers are pleased to obtain top-quality California representation at Midwestern rates.
Insofar as advisory issues are concerned, our practice is truly national in scope. We assist employers on a daily basis in developing best practices, writing policies, building programs, and taking steps to minimize litigation. We are particularly adept in helping employers avoid litigation and claims.
Our Litigation Team
Dave Schooler and Ellen Brinkman lead our EPL and D&O teams. Dave and Ellen are experienced litigators and members of the Professional Liability Attorney Network (PLAN). Dave and Ellen have nearly 50 years of collective experience, possess a deep understanding of all aspects of employment law, and are experienced trial lawyers.
We have constructed the remaining team to ensure that any litigation has the proper staffing and support, including multiple attorneys who are barred in California.
Our Advisory Team
Joe Schmitt and Mark Girouard lead our advisory team. Joe and Mark serve as “outside general counsel” for many national employers and provide strategic, preventative advice to employers across the country.
Our labor and employment attorneys have developed numerous sub-specialties, allowing Nilan Johnson Lewis to provide deep expertise to employers in a wide range of areas. Our advisory team is designed to ensure that we support our clients in all areas – including multiple attorneys who have extensive experience in California’s unique labor and employment laws.

We are available to represent insureds on claims across the upper Midwest (Minnesota, North Dakota, South Dakota, Nebraska, Iowa, and Wisconsin). Our litigators have handled matters in every state in the country and represent insureds nationally. Our attorneys are admitted in many states from California to New York and also routinely use Nilan Johnson Lewis’ membership in the American Law Firms Association (ALFA) network and connections to other attorneys, to appear pro hac vice in any other state.

Cort Sylvester leads our insured claims team. Cort has nearly 30 years of experience practicing exclusively in litigation. He has led teams handling matters on a regional basis and will ensure that the right members of the team are in place on all claims.
