Joe Schmitt Discusses Protected Concerted Activity in The Corporate Counselor

Nilan Johnson Lewis Shareholder and Chair of the Labor & Employment Practice Group, Joe Schmitt, authored an article in the October edition of The Corporate Counselor discussing the impact of the National Labor Relations Board’s decision in Hispanics United of Buffalo, Inc.  In this decision, the NLRB held for the first time that the employees’ discussion of their work on Facebook constituted protected concerted activity.

Considering the likelihood that employees are using at least one form of social media, the article recognizes the need for organizations to maintain social media policies to protect both the employer and the employee.  However, Schmitt notes steps employers can take when writing these policies to avoid running afoul of Hispanics United.  Please click here for a copy of the entire article which starts on page 3.
